1. Definitions
“Company” refers to The Masked House Pty Ltd.
“Client”, “User”, or “You” refers to any person or entity using services provided by the Company.
“Services” refers to all hosting, managed services, email services, support, infrastructure, and related offerings.
2. Acceptance of Terms
By accessing or using any website, service, or system operated or hosted by The Masked House Pty Ltd, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions, the Privacy Policy, and any related policies.
If you do not agree, you must discontinue use immediately.
3. Scope of Services
The Company provides web hosting, server management, email services, backups, maintenance, monitoring, and technical support on an “as-is” and “as-available” basis.
No guarantees are made regarding uninterrupted availability, performance, or error-free operation.
4. Acceptable Use Policy (AUP)
You may NOT use the Services to host, distribute, or facilitate:
Illegal content or activity
Malware, viruses, phishing, hacking, or exploitation
Spam, bulk email abuse, or unsolicited communications
Copyright infringement or piracy
Hate speech, harassment, or violent content
Cryptocurrency mining without authorization
Activities that degrade server performance or security
The Company reserves the absolute right to determine what constitutes abuse.
5. Client Responsibilities
Clients are solely responsible for:
All content hosted on their account
Legal compliance of their websites and communications
Obtaining all required consents, licenses, and permissions
Securing their own login credentials
Maintaining independent backups of their data
6. Monitoring & Enforcement
The Company may monitor systems, traffic, and usage to ensure security and compliance.
We may suspend, restrict, or terminate Services immediately and without notice if we believe there is a risk to systems, users, or legal compliance.
7. Payments, Fees & Non-Payment
Fees are payable as agreed
Late or failed payments may result in suspension or termination
No refunds are provided unless expressly stated in writing
All outstanding balances remain payable after termination.
8. Backups & Data Loss
Backups are provided as a courtesy service and are not guaranteed.
The Company is not responsible for:
Data loss
Corruption
Failed restores
Clients remain responsible for their own data protection strategies.
9. Suspension & Termination
The Company may suspend or terminate Services at any time for:
Policy violations
Legal or regulatory requirements
Non-payment
Security threats
Operational necessity
Termination does not waive outstanding obligations.
10. Intellectual Property
Clients retain ownership of their content.
The Company retains ownership of all systems, software, infrastructure, and proprietary tools.
Nothing in these Terms grants ownership or licensing beyond service use.
11. Limitation of Liability
To the fullest extent permitted by law:
The Company is not liable for indirect, incidental, special, or consequential damages
Total liability is limited to the amount paid by the Client in the three (3) months preceding the claim
This includes loss of data, profits, business, or reputation.
12. Indemnification
Clients agree to indemnify and hold harmless The Masked House Pty Ltd from all claims, damages, losses, or legal costs arising from:
Hosted content
Client activities
Legal violations
Third-party claims
13. Force Majeure
The Company is not liable for failures caused by events beyond reasonable control, including but not limited to natural disasters, power failures, cyberattacks, labor disputes, or government actions.
14. Third-Party Services
The Company is not responsible for third-party services, software, or platforms used in conjunction with the Services.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the Republic of South Africa.
All disputes shall be subject to the exclusive jurisdiction of South African courts.
16. Changes to Terms
The Company may modify these Terms at any time. Continued use constitutes acceptance of updated Terms.
